The Code of Iowa establishes a Statewide minimum wage, which currently mirrors the minimum wage established by federal law. In 2016, the Polk County Board of Supervisors approved an ordinance establishing a Countywide minimum wage, effective April 1, 2017, with future planned increases contained within the ordinance. While it is anticipated the State Legislature will likely take action to pre-empt any perceived Countywide authority on the issue of minimum wage, action has not yet taken place, leaving Polk County municipalities, including Ankeny, a few weeks from enactment of the Countywide minimum wage. In order to avoid conflicting minimum wages within the County, specifically Ankeny businesses falling under the purview of Polk County’s ordinance requirements—absent legislative action—the City Council will need to approve an ordinance stating that the City adopts the Statewide minimum wage, and therefore creating a conflict with the County-adopted minimum wage. If pre-emptive legislation and/or legislation establishing a higher Statewide minimum wage is signed into law prior to the March 20 City Council meeting, then the second and third readings of this ordinance would become moot as the State’s authority would prevail. |
