Crestbruck Park Splashpad Improvements Project:  Consider motion to approve: a) Change Order #5 decreasing the contract in the amount of $285.00; ; b) Certificate of Completion; (c) RESOLUTION accepting public improvements with Minturn, Inc., in the amount of $186,509.00; and d) Final Payment #4 in the amount of $4,384.25 and Release of Retainage in the amount of $9325.35.

EXECUTIVE SUMMARY:

The actions before the Council are the approval of the final Change Order, the acceptance of the Certificate of Completion, passage of a Resolution accepting the public improvements and approval of the final payment and retainage payment to Minturn Construction, Inc., for the Crestbruck Park Splashpad Improvements project. 

 

The Crestbruck Park Splashpad Improvements project is now complete including all final surface restoration. A series of actions are needed in order to close out this construction project:

 

a) Approval of the final Change Order #5 decreasing the contract amount by $285.00;

 

b) Engineer's Certificate of Completion: The attached Certificate of Completion from the project engineer states that the work performed was in substantial compliance with the plans and specifications and that the final contract amount is $186,509.00.

 

c) Resolution accepting the public improvements: This Resolution approves and adopts the Engineer's Certificate of Completion for the Crestbruck Park Splashpad Improvements project and establishes the final contract amount to be $186,509.00.

 

d) Final Payment - Minturn Construction Inc.             $4,384.25
    Retainage Payment - Minturn Construction Inc.     $9,325.35

 

It is recommended that the final payment on the project now be approved. The retainage payment should also be approved 31 days from the date of acceptance of the project, in accordance with the terms of the contract.

CITY MANAGER'S RECOMMENDATIONS:

It is recommended that the retainage payment be approved for payment 31 days from the date of acceptance of the project, in accordance with the terms of the contract.

 

It is recommended that the Council take the following actions:

 

1.  Approval of the final change order on the contract with Minturn Construction, Inc., decreasing the contract amount by $285.00. 

 

2. Accept the Certificate of Completion from the project engineer for the Crestbruck Park Splashpad Improvements project.

 

3. Adopt the Resolution accepting the Crestbruck Park Splashpad Improvements project with Minturn Construction Inc., in the final contract amount of $186,509.00.

 

4. Authorize the final payment in the amount of $4,384.25and release of retainage payment in the amount of $9325.35, in accordance with the terms of the contract.

PREVIOUS COUNCIL/COMMISSION/BOARD ACTION(S):

March 20: The Council ordered construction and set dates for bidding and public hearing.

 

April 17, 2017: The Council held the public hearing; adopted plans, specifications, form of contract and estimate of cost; awarded the construction contract and approved the construction contract and bonds.
