SUBJECT:
Ord 1930: An Ordinance amending the Municipal Code of the City of Ankeny, Iowa, Chapter 4 Municipal Infractions.
EXECUTIVE SUMMARY:
In 2016 we amended the penalty section in our city code to include simple misdemeanors for enforcement of a few of our ordinances including Chapter 41 Public Health and Safety. On July 1, 2017 a new state law was passed that amended Iowa Code 815.15 which extended free legal counsel to persons declared indigent if charged with an offense that included the possibility of jail. This amendment  to city code 4.06 excludes jail time in our penalty section and allows for fines or forfeitures only upon conviction. This amendment protects the city against legal costs provided to defendants charged under local city code.
