Nilles Associates, Inc.,completed the design of the SW District Drive and SW Merchant Street project and the project was bid locally on May 9, 2017.  The Public Works Department continued using Nilles Associates to complete the necessary construction engineering services for the project via Amendment No. 1, approved by Council on June 19, 2017.  The purpose of  Amendment No. 2 is to account for the additional services completed by the Nilles Associates due to separating the landscaping portion of the project into a stand-alone project and the extension of the project's construction duration due to the Contractor significantly exceeding the allotted working days designated in the construction Contract.  The scope of the additional construction engineering services and landscaping design, bidding and construction services along with the corresponding fees are shown in the attached Amendment No. 2 to the Professional Services Agreement.  A copy of the original Professional Services Agreement and Amendment No. 1 are also attached for reference.

The total fee for the additional design, bidding, and construction engineering services is $100,800.00.  The original Professional Services Agreement for design engineering services was $186,500.00 and Amendment No. 1 was $158,200.00.  Adding Amendment No. 2 to the Professional Services Agreement increases the overall contract amount to $445,500.00.

It is recommended that the City Council approve Amendment No. 2 to the Professional Services Agreement with Nilles Associates in the amount of $100,800.00 for the SW District Drive and SW Merchant Street project.
