| Consider motion to adopt RESOLUTION authorizing the Mayor to sign a development agreement with Kwik Trip Inc., concerning the construction of a traffic signal at the intersection of NW 36th Street and the private drive east of Kwik Star (Lot 3, Autumn Crest Plat 8) in the City of Ankeny, Iowa. |
| EXECUTIVE SUMMARY: |
| Kwik Trip Inc., has asked the City to enter into a Development Agreement that outlines certain terms and conditions for the construction of a traffic signal at the intersection of NW 36th Street and the private drive east of Kwik Star in the City of Ankeny. Kwik Trip Inc. and City staff agreed to a set of terms and conditions outlined in the Development Agreement, and a copy of said Development Agreement is attached for reference. The traffic signal at the NW 36th Street and the private drive east of Kwik Star intersection are not currently programmed in the City's Capital Improvements Program (CIP); however, the City will need to begin the design of the traffic signal when the traffic warrants are met, which is assumed to be by year 2025, in order to adhere to the terms of the Development Agreement. This project is associated with Lot 3 of Autumn Crest Plat 8. |

| CITY MANAGER'S RECOMMENDATIONS: |
| Approve the Development Agreement with Kwik Trip, Inc., for the construction of a traffic signal at the intersection of NW 36th Street and the private drive east of Kwik Star and authorize the Mayor to execute said agreement. |
