SUBJECT:

Consider motion to adopt RESOLUTION approving a 28E Agreement between the City of Ankeny and the Iowa Alcoholic Beverages Division ("ABD") for a tobacco, Alternative Nicotine and Vapor Product Enforcement Program in the City of Ankeny.

EXECUTIVE SUMMARY:
The Iowa Alcoholic Beverages Division annually invites law enforcement agencies to participate in the Iowa Pledge program.  The Iowa Pledge 28E agreement requires the Ankeny Police Department to perform one (1) compliance check for each licensed retail business selling tobacco products.  

The process involves youth volunteers working with law enforcement officers attempting to purchase tobacco products from licensed businesses.  Ankeny Police Department has participated in the program since its inception in 2000. 

The City of Ankeny has 41 licensed tobacco retailers and all would be checked during the campaign which commences October 2019.
FISCAL IMPACT: Yes
The City is reimbursed $75 for each reported compliance check.  ABD renews the 28E agreement annually because it is tied to their annual budget which supports the funding and reimbursement to local communities.
CITY MANAGER'S RECOMMENDATIONS:

City Manager recommends approval of this 28E Agreement with the Iowa Alcoholic Beverages Division for a Tobacco Sales Enforcement Program in the City of Ankeny.
