SUBJECT:
Ord 2008: An Ordinance amending sections 41.13 Fireworks; 41.15 Underage Drinking Parties; 44.05 Sounds Not Allowed; 55.06 At Large Prohibited; 55.08 Annoyance or Disturbance; 150.11 Dumping of Snow - setting out scheduled violations.
EXECUTIVE SUMMARY:
The Ankeny Police Department is proposing to change five ordinances from simple misdemeanor infractions to scheduled violations.  The reason for this is to simplify the process not only for the officer writing the ticket, but the offender as well.  Under the current process the offender is required to appear in court and face up to a $650 fine and considered an arrest record.  If these offenses are made into scheduled violations there is a set fine and no requirement for the offender to appear in court unless they choose to.  The five ordinances are as follows:
FIREWORKS 41.13
UNDERAGE DRINKING PARTIES 41.15
SOUNDS NOT ALLOWED 44.05
AT LARGE PROHIBITED 55.06
ANNOYANCE OR DISTURBANCE 55.08
DUMPING OF SNOW 150.11

FISCAL IMPACT: No
